Sean “Diddy” Combs’ legal team has filed a second motion for a mistrial in his federal sex trafficking and racketeering case. This follows the first motion, which was filed in May and swiftly denied by Judge Arun Subramanian.

In this new motion, Diddy’s defense team alleges prosecutorial misconduct, asserting that the prosecution knowingly presented false testimony that could unfairly influence the jury’s judgement.

Specifically, the defense contends that the prosecution introduced testimony from Cassie Ventura, a former girlfriend, and Bryana Bongolan, a longtime friend of Ventura, regarding an alleged 2016 incident in which Combs’ dangled Bongolan from a balcony. The defense argues that text records show Ventura learned of the event after it occurred, rendering her testimony “demonstrably false.” Additionally, the defense challenges the authenticity of injury photos submitted by the prosecution, claiming they were mislabeled and do not correspond to the alleged incident. They further argue that their cross-examination efforts were improperly hindered by the prosecution, which has one day to respond to the current motion.

Combs, arrested in September 2024, is accused of racketeering conspiracy, sex trafficking by force, and transportation to engage in prostitution. He has pleaded not guilty to all charges, but if convicted, he could face a life sentence.

The trial, which began on May 5, 2025, has heard from several witnesses. Ventura testified about a decade-long abusive relationship, detailing incidents of physical and sexual violence. Another accuser, known as “Jane,”, described being coerced into participating in drug-fueled sex parties, even after FBI raids on Combs’ properties. These testimonies have been central to the prosecution’s case, highlighting patterns of manipulation and control.

The trial is expected to conclude by July 4, 2025.
