SWEEPSTAKES DESCRIPTION:
Rickey Smiley Morning Show Madea’s Big Happy Family Sweepstakes (“Sweepstakes”) will begin on April 11, 2011 and end on April 22, 2011 (“Sweepstakes Period”). This Sweepstakes will be conducted through various radio and online networks and one (1) grand prize will be awarded to one (1) winner. The grand prize is a Fun Family Getaway (a long weekend for a family of four (4)) to: Walt Disney World® in Orlando, Florida, or Disneyland® in Anaheim, California.
HOW TO ENTER:
Listeners of The Rickey Smiley Morning Show (also “RSMS”) on affiliate stations including, but not limited to KBFB-FM, WHTA-FM, WHTD-FM, WEDR-FM, WHHL-FM, WERQ-FM, KVSP-FM, WGNL-FM, WJZE-FM, WEUP-FM/WEUZ-FM, WFXA-FM, WRBJ-FM, WQHH-FM, WOWE-FM, KBTT-FM, WIBB-FM, WEAS-FM, WBFA-FM, WJJN-FM, WRSV-FM, KBCE-FM, KRVV-FM, WJIZ-FM, WMSU-FM, WJXM-FM, WKJX-FM, KCLT-FM, WENN-FM, KJMM-FM, WHXT-FM, WYLX-FM, WENZ-FM, WWPW-FM, WTMG-FM, WIHB-FM, WDAI-FM, KZTS-FM, KBLZ-FM, KAZE-FM, WYNN-FM, WJHM-FM, WKXN-FM, WMNX-FM, WRVZ-FM and KJMZ-FM (the “Participating Stations”) who are legal residents of the U.S. (except Rhode Island), and are eighteen (18) years of age and older at the time of entry will be able to take part in this Sweepstakes. To participate in the Sweepstakes, listeners must do the following:
1. Listeners must register for a chance to win the Sweepstakes via a link to the online registration form provided on the RSMS website at http://www.rickeysmileymorningshow.com. From all eligible entries received through participating radio and online networks, one (1) Grand Prize winner will be selected at random on Monday April 25, 2011.
2. Upon entering the Sweepstakes website, participants are to follow the on-screen instructions, including entering their name, date of birth, address, phone number, email address, and any optional or additional contact information. The Sweepstakes website will also provide participants with an opportunity to view the movie trailer for “Madea’s Big Happy Family”.
3. All Internet entries must be received by 11:59pm Eastern Time on April 22, 2011 or they will be void.
4. One entry per person per day per email address during the Sweepstakes Period. Online entrants may only register through websites of radio stations in their listening area.
5. In the event of a dispute regarding the identity of a participant’s online entry, the entry will be deemed to have been made by the authorized holder of the e-mail account at the time the entry was made.
ELIGIBILITY RESTRICTIONS:
1. The Sweepstakes is open to listeners of the RSMS who are eighteen (18) years of age and older at the time of Sweepstakes entry and are legal residents of the U.S. (except Rhode Island).
2. Employees of The Rickey Smiley Morning Show, the Participating Stations, Syndication One, Radio One, Inc. (“Radio One”), TV One, LLC, Interactive One, LLC, REACH Media Inc, Lionsgate (collectively, “Sponsor”), Dial Global Communications, and each of their respective parents, subsidiaries, affiliated companies, promotion partners, sponsors and advertising and promotional agencies (together with Sponsor, collectively, the “Sweepstakes Entities”) and their immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and those living in their same households (whether or not related) are NOT eligible to participate or win in this Sweepstakes.
3. Once an individual wins a prize in this Sweepstakes, they are not eligible to win another prize in this Sweepstakes except as specified within these rules.
4. Persons who have won a prize in another Sweepstakes or promotion of any kind from the RSMS within the thirty-day (30) period immediately preceding the start date of this Sweepstakes are not eligible to participate.
5. Winner and guests must possess required travel documents (e.g. valid government-issued photo I.D.) prior to departure and travel together on the same itinerary. Travel guests of the Grand Prize Winner must also be legal residents of the U.S. Travel guests will be required to sign and submit all requested release forms along with the grand prize winner. If a travel guest is under the age of eighteen (18), they must be accompanied by their parent or legal guardian who must sign and submit all requested release forms.
6. The Sponsor at its sole discretion will choose whether or not to air the winning notification call or publish the name of the day’s Winner. Sponsor assumes no responsibility for any computer, telephone, cable, network, electronic or internet hardware or software malfunctions, failures, connections, availability, traffic congestion, unauthorized human intervention, or any error or malfunction.
PRIZES:
1. Grand Prize for one (1) winner (and three (3) guests of winner’s choosing) to include a Fun Family Getaway (a long weekend for a family of four (4) to: Walt Disney World® in Orlando, Florida, or Disneyland® in Anaheim, California (location to be determined by Sponsor). Prize also includes:
• round trip coach airfare for four (4) from a metropolitan airport nearest the winner’s residence within the continental U.S.
• hotel accommodations for three (3) nights; one (1) standard hotel room; occupancy for four (4)
• round trip ground transportation between airport and hotel
• passes for chosen park
• meals at chosen park
The estimated retail value of the vacation package is $10,000. Actual value will vary depending on winner’s point of departure and airfare fluctuations. If the actual value of the prize is less than the stated approximate retail value, the difference will not be awarded in cash. If for any reason a portion or whole prize cannot be awarded, the Sweepstakes Entities reserve the right to award a prize of equal or greater value.
Additional ground transportation, meals outside of the park, beverages, hotel room service, laundry service, local and long distance telephone calls, merchandise, souvenirs, incidentals, tips, gratuities, service charges or taxes, ground transportation between winner’s residence and the departure airport, luggage costs, and all other charges and items not otherwise described above are the responsibility of the winner and his or her guests.
Prize trip must be completed within six (6) months of being awarded or winner forfeits the prize package. Travel dates and lodging are subject to availability, and certain restrictions and blackout dates may apply.
2. No substitution of prize is offered, no transfer of prize to a third party is permitted and non-cash prizes may not be redeemed for cash value, except as determined by station management and/or the sponsor in its sole discretion.
3. All Sweepstakes winners must sign and date official station release and waiver forms as requested. All forms must be returned within thirty (30) days of issue, failure to do so will result in winner forfeiting the prize.
4. If for any reason a Sweepstakes winner provides notice that he or she has decided not to accept an awarded prize, the winner will be required to sign a release form acknowledging that they are forfeiting the prize. It will be at the discretion of the Sweepstakes sponsor and / or Sweepstakes administrator if another Sweepstakes winner is to be selected as the winner if time permits.
5. Dates and times of concerts, events, and trips promoted by sponsors are subject to change and those changes are deemed to be beyond the control of the Sweepstakes Entities. Changes of venue, cancellation of engagements by performing artists, and/or their management may be permanent in nature. The Sweepstakes Entities are not obligated to make any effort to find an alternative prize under these circumstances.
6. If a winner does not claim their prize within three (3) days of winning notification, the prize will be forfeited.
7. Sweepstakes Winners must provide valid identification (i.e. via driver’s license, passport or other photo I.D.) to claim their prize.
8. Sponsor and its affiliates, agents and subsidiaries will have no responsibility or liability for damages, losses or injury of any kind resulting from in connection with acceptance, possession, use or misuse of any prize.
EXECUTION:
1. During the Sweepstakes Period, eligible participants will be encouraged to take part in the Sweepstakes by registering online via a link at http://www.rickeysmileymorningshow.com. After completing the registration process, qualified entrants will be eligible for a chance to win the grand prize.
2. The grand prize drawing will take place on April 25th. The winner will be selected by random drawing from among all eligible entries received electronically through participating online and radio networks.
3. The grand prize winner will be notified by a representative of Syndication One and/or Sponsor via phone and provided with instructions for claiming their prize.
4. Decisions of the Sponsor with respect to any aspect of the Sweepstakes are final.
GENERAL CONDITIONS:
1. Winners are responsible for all applicable taxes associated with the receipt of the prize (prizes are not transferable and may not be exchanged).
2. Any person winning over $600.00 in prizes will receive an IRS form 1099 at the end of the calendar year for tax purposes and a copy of such form will be filed with the IRS as required by law.
3. No purchase necessary. Sweepstakes is void where prohibited. Sweepstakes is subject to all applicable federal, state and local laws and regulations.
4. Odds of winning depend upon the number of eligible entrants that register through participating radio and online networks during the Sweepstakes Period.
5. By participating in the Sweepstakes, the winner or winners agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this Sweepstakes, in any media now known or hereafter devised for advertising or promotional purposes without additional compensation, and must sign a publicity release prior to acceptance of the prize. By entering this Sweepstakes, each participant agrees to comply with the Official Rules and the decisions of the Sweepstakes sponsor which shall be final and binding in all aspects relating to the Sweepstakes.
6. All Sweepstakes winners will be required to sign a liability release prior to acceptance of any prize. Pursuant to the liability release, the winner or winners will agree to hold The Rickey Smiley Morning Show, the Participating Stations, Sponsor, Dial Global Communications, any other Sweepstakes parties and each of their respective affiliates, subsidiaries, agencies, officers, shareholders, directors, employees, agents and representatives of each of the foregoing, harmless against any and all claims or liability, directly or indirectly related to or arising from or in connection with Sweepstakes participation or the acceptance, possession or use / misuse of awarded prize or any portion thereof, or participation in prize-related activities, including but not limited to any related travel.
7. Winners must provide valid identification (i.e. via driver’s license, passport or other photo I.D.) to claim their prize.
8. The Sponsor retains the right to disqualify any Sweepstakes winner if all Sweepstakes rules are not followed; Sweepstakes void if prohibited by law.
9. Sponsor reserves the right to make changes in the rules of the Sweepstakes in its sole discretion at any time without notice, which will become effective immediately upon being announced on the air and / or posted online. In the event any Winner is found to be in violation of these Official Rules or is otherwise determined by Sponsor, in its sole discretion to be ineligible, he/she will be required to forfeit prize or to reimburse the Sponsor for the stated value of a prize if such a violation is found after the prize has been used by Winner.
10. The Rickey Smiley Morning Show, the Participating Stations, Sponsor, Dial Global Communications, participating sponsors and their respective parent companies, subsidiaries, affiliates or their representatives, agents and employees are not responsible for the inability of any Sweepstakes winner to complete or continue a telephone call, facsimile transmission or internet registration due to equipment malfunction, busy lines, inadvertent disconnections, unavailable network, server, Internet Service Provider (ISP), communication failures or human error that may occur in the transmission, receipt or processing of entries. In addition, The Rickey Smiley Morning Show, the participating stations, Sponsor, Dial Global Communications, participating sponsors and their respective parent companies, subsidiaries, affiliates or their representatives, agents and employees are not responsible for lost, misdirected, mutilated, illegible or incomplete Sweepstakes entries. Once submitted, entries become the property of the station and will not be returned.
11. By accepting the prize, the winner acknowledges that The Rickey Smiley Morning Show, the Participating Stations, Sponsor, and Dial Global Communications have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, express or implied, in fact or in law, relative to the prize or to any portion thereof, including but not limited to its quality, mechanical condition or fitness for a particular purpose.
12. The Rickey Smiley Morning Show, the Participating Stations, Sponsor, Dial Global Communications, their respective subsidiaries, affiliates, participating sponsors and promotional partners will not assume any responsibility for any changes in the execution of the Sweepstakes, including; cancellation of the Sweepstakes as a result of the occurrence of events not within the control of The Rickey Smiley Morning Show, the Participating Stations, Sponsor, Dial Global Communications, their respective subsidiaries, affiliates, participating sponsors, promotional partners and other radio stations, such as acts of God, strikes, terrorists acts or criminal acts of third parties.
13. The Rickey Smiley Morning Show, the Participating Stations, Sponsors, and Dial Global Communications are not responsible for any incorrect or inaccurate entry information, whether caused by any of the equipment associated with or utilized in the Sweepstakes, and assume no responsibility for error omission, interruption, defect, failure, malfunction or delay in operation or transmission, or for any damage to participants phone, cell phone, mobile device, computer, hardware, software, or any other device, or for theft or destruction, tampering or unauthorized access to entry information, or for entries which are misdirected, inaccurate, incomplete or, inaudible, disconnected or any combination thereof) or for preemption or cancellation of the radio program, or for technical, network, typographical, human or other errors or problems relating to or in connection with the Sweepstakes, including, without limitation, errors or problems which may occur in the connection with the administration of the Sweepstakes, the announcement of prizes in any Sweepstakes-related materials. If for any reason the Sweepstakes is not capable of running as planned by reason of tampering, unauthorized intervention, fraud, technical failures, acts of God, strikes, terrorists acts, criminal acts of third parties, an insufficient number of qualified Sweepstakes entries, or any other causes which, in the sole opinion of Sponsor, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, Sponsor reserves the right at its sole discretion to cancel, terminate, modify, or suspend the Sweepstakes (or any portion thereof). Any attempt to defraud Sponsor in any way will result in de-qualification of participant, and such participant will be prosecuted to the fullest extent of the law. IN NO EVENT WILL SPONSORS AND/OR SWEEPSTAKES ENTITIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUR OF ANY ENTRANT’S PARTICIPATION IN THE SWEEPSTAKES.
